Section 63 – Scotland

From the 1st September 2016, Section 63 legislation will be active in Scotland.

This will require owners of non-domestic buildings (over 1000m²) eligible for an EPC for sale or rent, to have an additional assessment carried out.

Section 63 is triggered by either sale or by lease to a new tenant. Generally, owners of such buildings also require to provide a valid Energy Performance Certificate (EPC) in such situations. Buildings that meet energy standards equivalent to those introduced by the 2002 building regulations (these buildings are already reasonably energy efficient); or are already improved via a Green Deal (a UK Government funding mechanism) are exempted from the regulations.

Where the regulations apply, the owner of the building must undertake further assessment to produce an ‘Action Plan’ which identifies targets for improvement of the carbon and energy performance of the building and how these targets would be met through physical improvements to the property. Once an Action Plan is finalised, the owner can choose to improve or to defer the improvements by reporting operational energy ratings (actual measured energy use via a Display Energy Certificate or ‘DEC’) on an annual basis. All Action Plans and DECs are lodged to the Scottish EPC Register.

As is the case with an EPC, the Action Plan must be made available to prospective buyers or tenants and provided to the new owner or tenant. Provision of the Action Plan is all that is required to enable marketing of the property. Building on the existing EPC assessor role, the Action Plan will be produced by persons also registered as a ‘section 63 advisor’, who have demonstrated competence in the assessment procedure and the provision of improvement advice to building owners.

DEC Asset Rating

Do you want to find out how green your building is? The recent regulatory and legal changes have resulted in the need to improve energy performance in public buildings. The Display Energy Certificates are now a requirement for all public buildings greater than 500m2.

This new legislation under the Energy Performance of Buildings (England and Wales) Regulations 2012 now requires that DECs and their accompanying advisory report, which contains recommendations for any possible improvements to the energy performance of that building, are now required for buildings of greater than 500m² which are partly or wholly occupied by a public authority and are open to visiting by member of the public.

The DEC which must be displayed in a prominent place clearly visible to the public is valid for 12 months and the advisory report for seven years for buildings which exceeding 1000m² total floor space, and for those with a total used floor area 500m² to 1000m², the DEC and advisory report are valid for 10 years.

How to organise an air conditioning inspection
